- or 15 GB of Usage (storage + delivery)
...whichever comes first.
1. CONTENT
Any material (Content) that you make available to sermon.net and its affiliate providers is and remains your sole property or the property of your licensors.
By making available any Content, you automatically grant sermon.net, (the Hosting Provider) and its affiliate providers the royalty-free, non-exclusive right to store, access, view, and playback the Content through their sites in perpetuity.
2. YOUTUBE APIs
By using the YouTube APIs (live stream and/or file share), you are agreeing to be bound by the YouTube Terms of Service.
Sermon.net only stores the token that YouTube returns upon connection of the user's account with our application. We do not collect or store any other information about a user's account.
3. META / Facebook TERMS
a. The only Facebook specific data we store is the token used to connect your sermon.net account to our Facebook App to allow for posting and Live Streaming.
b. If you would like your Facebook data removed from our system, please submit your request to us via email (send email request to: support@sermon.net).
4. CONDUCT
You agree to use sermon.net only for lawful purposes. You are solely responsible for the knowledge of and adherence to any and all laws, statutes, rules and regulations pertaining to your use of sermon.net.
You agree to not use sermon.net to:
a. make available any Content that you do not have a right to make available;
b. make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
c. make available any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation;
d. make available any Content that is unlawful, obscene, libelous, or contains software viruses, trojans, worms, data miners, spyware, malware, or any other content judged to be unacceptable by the Hosting Provider.
sermon.net and its services are for use by individual churches and ministries. You are therefore prohibited from selling and/or marketing the services provided by sermon.net as your own. Any requests to use sermon.net for commercial or other purposes must be submitted in writing to sermon.net. This includes but is not limited to the use of one account to broadcast multiple authors, channels, or types of content. You may not use a single sermon.net account to serve as a portal to distribute the content of several authors from unique ministries. Violation of these terms can result in the immediate removal of your content and/or account entirely.
5. TERMINATION
The only right with respect to dissatisfaction with any policies or practices of the Hosting Provider in operating sermon.net is for you to discontinue using sermon.net. The Hosting Provider, in its sole discretion, may terminate or temporarily suspend your access to all or any part of sermon.net, for any reason, without notice. The Hosting Provider and its affiliate may discontinue operating sermon.net, and/or terminate this Agreement without notice at any time for any reason in their sole discretion.
6. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
sermon.net, IS PROVIDED BY THE HOSTING PROVIDER ON AN ‘AS IS’ AND ‘AS AVAILABLE’ BASIS. THE HOSTING PROVIDER AND ITS AFFILIATE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, THE HOSTING PROVIDER AND ITS AFFILIATE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE HOSTING PROVIDER AND ITS AFFILIATE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. USER AGREES TO HOLD HARMLESS SERMON.NET AND ITS AFFILIATE PROVIDERS IN THE EVENT THAT THIS SERVICE IS TERMINATED OR CONTENT IS LOST OR NO LONGER AVAILABLE, FOR ANY REASON.
7. PRIVACY AND FREE SPEECH
We are committed to protecting your privacy. The personal information we collect is only that which is needed to provide the services we offer. We do not divulge this information to other parties unless we deem it necessary to resolve a dispute regarding these Terms of Service.
We support freedom of speech in the use of our services. However, your speech must be done in a lawful and responsible manner. You agree that the Hosting Provider is not responsible for your content, and the views and opinions expressed are your own.
8. GENERAL
By using sermon.net, and as provided through its affiliate, you agree to the above stated terms of use and to our site policies. By using sermon.net and providing us your email address, you agree to receive periodic emails to the account contact(s) with information pertinent to the account. These terms of service can be modified at the discretion of sermon.net. The venue for all actions under this Agreement shall be the appropriate state or federal court sitting in Tulsa County, Oklahoma.
9. BILLING & CANCELATION
Billing Cycle. The license fee for the sermon.net service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the "Billing" page. The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the service. Membership fees are fully earned upon payment. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid membership began on a day not contained in a given month. Visit the sermon.net website and click on the "Billing" tab link on the "Account" page to see your next payment date. We may authorize your Payment Method in anticipation of membership or service-related charges through various methods, including authorizing it up to approximately one month of service as soon as you register. If you signed up for sermon.net using your account with a third party as a Payment Method, you can find the billing information about your sermon.net membership by visiting your account with the applicable third party.
Payment Methods: To use the sermon.net service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Check with your Payment Method service provider for details.
Updating your Payment Methods: You can update your Payment Methods by going to the "Account" page and then "Billing" tab. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
Cancellation: You can cancel your sermon.net membership at any time, and you will continue to have access to the sermon.net service through the end of your billing period. To cancel, go to the "Account" page on our sermon.net website and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. If you signed up for sermon.net using your account with a third party as a Payment Method and wish to cancel your sermon.net membership, you may need to do so through that third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the sermon.net service through that third party.
Changes to the Price and Subscription Plans: We may change our subscription plans and the price of our service from time to time; however, any price changes or changes to your subscription plans will apply no earlier than 30 days following notice to you. If you do not wish to accept the price change or change to your subscription plan, you can cancel your subscription before the change takes effect.
No Refunds: Payments are nonrefundable and there are no refunds or credits for partially used membership periods. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members ("credits"). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future under any circumstance.
